Affiliate program terms

1. What this agreement covers
These terms govern your participation in the PeoplesPicks affiliate program. By accepting them you agree to promote PeoplesPicks in exchange for commission on the members you refer, on the terms set out below. This is a non-exclusive, revocable arrangement — it does not make you an employee, agent, partner, or joint venturer of PeoplesPicks, and it does not give you authority to make commitments on our behalf.
2. Joining the program
The program is invite-only. You participate using your existing PeoplesPicks account — there is no separate affiliate login. You must be at least 18 years old, legally able to enter into this agreement, and in a jurisdiction where participation is lawful. You are responsible for the accuracy of the details on your account, including the payout details you provide.
3. Your referral link, code and QR
We issue you a unique referral code, which forms your referral link and QR code. You may customise your code at any time from your dashboard. Changing your code immediately changes your link and QR: anything you have already shared using the old code will stop attributing referrals to you. You may not register codes that impersonate PeoplesPicks, imply official or staff status, or infringe anyone's trademark.
4. How a referral is attributed
A person is attributed to you when they create a PeoplesPicks account after arriving through your link, or after entering your code at signup. Attribution is first touch: if someone arrives through more than one partner's link, the first code recorded against them wins. A member can only ever be attributed to one affiliate, and attribution is permanent once set. Referral codes stored in a visitor's browser expire after 60 days.
5. Commission and tiers
You earn a percentage of the subscription revenue we actually collect from members you refer. Your rate is set by how many of your referred members are currently paying subscribers, using a blended tier — your band applies one rate to all of your earnings, rather than different rates to different members. The current tiers are published on your dashboard and on the program page. Commission accrues for as long as each referred member remains subscribed. Commission is calculated on amounts we actually receive — after discounts and promotional credits, and excluding taxes and payment processing fees.
6. Changes to commission rates
We may change the tier structure. When we do, we will notify you by email and in your dashboard before the change takes effect, and the new rates will not apply until at least 24 hours after that notice. Commission already earned is never recalculated: each commission records the rate that applied when it was earned. If you do not accept a change, your remedy is to leave the program before it takes effect.
7. Refunds, chargebacks and cancellations
If a payment we have paid or accrued commission on is later refunded, reversed, or charged back, the corresponding commission is reversed. If it has already been paid to you, it is deducted from your next payout. A member who stops paying no longer counts toward your tier from that point on. We do not pay commission on payments we do not keep.
8. Payouts
Commission accrues as pending and becomes payable once approved. Payouts are made to the payout method on your account, in US dollars, once your approved balance reaches the published minimum. You are responsible for providing accurate payout details; we are not liable for funds sent to details you supplied incorrectly. Unclaimed balances on a closed account are forfeited after 12 months.
9. Taxes
You are solely responsible for any taxes on what you earn. You are an independent contractor, not an employee — we withhold nothing. Where the law requires it, you must give us valid tax documentation before we can pay you, and we may report amounts paid to you to the relevant tax authority.
10. How you may promote us
You must be honest. You must clearly disclose that you earn commission wherever you share your link — this is required by the FTC in the US and by equivalent rules elsewhere. You must describe PeoplesPicks accurately as a sports prediction content service, and you must not promise winnings, profits, guaranteed outcomes, or any specific result. You must not misrepresent our published record, which is available in full on our public ledger.
11. What is not allowed
You may not: refer yourself, or sign up through your own link using an alternate account, email or payment method; create fake, incentivised, or automated signups; use spam, unsolicited bulk messaging, or malware; bid on our brand terms in paid search or run ads that imply you are PeoplesPicks; use our name in a domain, app name, or social handle that suggests you are us; promote us on sites containing illegal, hateful, or adult content; target anyone under 21; or promote us in a jurisdiction where our service may not lawfully be marketed. Accounts showing an unusual pattern of signups may be held for review, and commission does not accrue while a referral is under review.
12. Our brand
We grant you a limited, revocable, non-transferable licence to use the PeoplesPicks name and logo solely to promote us under these terms, in their supplied form and without alteration. This licence ends when your participation ends, and you must stop using our brand at that point. All rights in our brand, content, predictions, and ledger remain ours.
13. Suspension and termination
Either of us may end this arrangement at any time, for any reason, with notice. We may suspend or terminate your participation immediately and withhold unpaid commission if we reasonably believe you have breached these terms or engaged in fraud. On termination you must stop using your link, code, QR, and our brand. Commission properly earned before termination remains payable, subject to the refund and clawback rules above.
14. No guarantees
PeoplesPicks publishes probability estimates. Predictions are often wrong and losing runs are statistically certain. Nothing in this agreement is a representation about how the service will perform, how many members you will refer, or how much you will earn. We may change, pause, or discontinue the program or any subscription plan at any time.
15. Liability
To the fullest extent the law allows, our total liability to you under this agreement is limited to the commission properly payable to you in the three months before the claim arose. We are not liable for indirect or consequential losses, including lost profits or lost opportunity. You are responsible for how you promote us, and you agree to cover us against claims arising from your promotional conduct or your breach of these terms.
16. Changes to these terms
We may update these terms. Material changes are notified by email and in your dashboard, and take effect no sooner than 24 hours after notice. Each version is dated, and your dashboard records which version you accepted. Continuing in the program after a change takes effect means you accept it.
Governing terms
Our general terms of service and privacy policy also apply to you as a member. Where they conflict with this document on affiliate matters, this document governs.
